"Section 202(a)(5) of the Immigration and Nationality Act provides that if total demand will be insufficient to use all available numbers in a particular Employment preference category in a calendar quarter, then the unused numbers may be made available without regard to the annual �per-country� limit. It has been determined that based on the current level of demand being received, primarily by Citizenship and Immigration Services Offices, there would be otherwise unused numbers in the Employment Second preference category. As a result, numbers have once again become available to the India Employment Second preference category. The rate of number use in the Employment Second preference category will continue to be monitored, and it may be necessary to make adjustments should the level of demand increase substantially. "
At the risk of stating the obvious there was not any spillover this month but there is hope that we may see spillover in future months.

How do you know that the labour process has slowed down from Mar 01 2011 ? Any source for this info? Please share.

The 1st quarter ends Dec 31. So technically, USCIS has until that to allocate the total of 35,000 visas. Now, let's assume they have only approved 5000 visas across all categories thus far, then that doesn't mean they can go and allocate the remaining 30,000 in December to the retrogressed countries.
I think the way the spillover works (except for the last month of last quarter) is at the end of the quarter (technically Jan bulletin is published around Dec 15) based on the demand for the last 2 weeks for that quarter, USCIS will spillover visas. So I think we should wait until the Jan bulletin that comes out in December before we push for a lawsuit. If you want to send letters to people, then so be it, but I am pretty sure USCIS is well within its operating procedure wrt spillover. If spillover doesn't happen in the Jan bulletin, then we have ground for a strong case.

I had a soft LUD on 4/22 and now this :) :).
Btw: I did not get any email for my wife's case(derivative application) which is pending at the Newark, NJ office(interview done in Feb 08') !

Good question are u talking about G325A i dont know whether this is the right way but what i did is filled up another form with rest of details in table col as you might need to do this 4 times as they need four copies of same form , dont copy it though as bottom left no.s differ , may be others can suggest a better approach?

How can you say dates will become current when I send the response.This could be a blessing for you.As your 485 file is now open depending upon your reply if IO is convinced he could easily mail out the GC to you as your dates would be current by the time he looks into your reply.Consult an attorney to frame a correct reply.

Guys,
Just an update..I quit the company and joined small consulting firm. Got the project, labor approved, h1b approved (filed in premium) and prewailing wage determination will be started from next week.damn, i should ve done this 4 yrs back. these guys r fast. Never join as fulltime employee if you dont have green card

We had CEO of HR sign it. Here is general format.
1. BACKGROUND of Company
2. description and requirement for the position
3. AC21 compatibility explaination - 180 days etc, Job description comparision with PERM
4. Conclusion and offer for employment with salary details.
I must say in my case the salary i had in original perm was way(40%) more than i am getting on my current job due to location change and economy etc. But it seems salary didn't matter.

not even 2002, it's just 01Jan2002, means only 2001.
EB2 person who applied for greencard in 2006 getting the GC wth the person who applied in EB2 - 2006.
This gap between EB2 and EB3 is keep on increasing....
EB2 move is in Months....EB3 move not even in Days...
I'm not against EB2... but just comparing.:(
