Does this vote gives us an overview of how the PDs might be spread out all over? From this poll, it looks like there are not many applications from Jan 2005 onwards as compared to prior to Jan 2005.

Once that back log is cleared, things wont be as bad for the rest? What do you think?

All the data shows that we have 20K EB2 I/C with PD before 6/1/2006, and it is comparable with the unused 20K quota from EB1 and EB2-ROW. As stated by Openhemer, the 2 year jump is due to the spillover of 20K to EB2 instead of EB3-ROW and there will NOT be any significant retrogression in Oct. However, a petition is being organized in this forum to stopping this spillover. Only if the petition succeed, we will see EB2 date goes back to 2004.

EB2-India folks should also initiate a petition campaign (on lines of the EB3-India folks) to make sure that these 25K visas do get adjudicated before fiscal year 08 ends.
USCIS may well end up wasting a bulk of these visas, contending that since they are statutorily required to adjudicate all EAD applications within 90 days, and there is a surge in EAD renewals because of (a) July-07 visa bulletin fiasco; and (b) people applying for renewal this month, hoping to get 2 year EAD. Therefore, because of surge in EAD applications, they do not have resources to use up all of this years visa numbers.
If this happens even EB3 India will be potential losers also.

So, basically anyone laid off on I485 pending without a job is accumulating "out of status" days. That's your opinion?

If you are I-485 pending, you are not out of status regardless of whether you have a job or not.

I'm sure most cases have recd at least a computerized review by now, many of the LUDs are for fingerprinting, name checks, change of processing centers etc. Yes there is definitely activity.
However, it does not mean that all pre Jun06 cut-off cases have been pre-adjudicated.

I agree. Infact my application hasnt even been touched once (July 2, RD), no soft LUD either, even after FP .. makes me believe that there might be other applications out there too that have never been touched so we cant assume that all the cases prior to July 2007 have already been pre-adjudicated, just because the processing-dates at NSC say July 2007. I think the processing dates reflect only those cases whose PD was current when the processing-dates timeframe came out. We will know more accurately when the processing-dates are updated next month. If the processing-dates, even after next month's update remain at July, 2007, then we can probably assume that our cases have already been pre-adjudicated. (still makes me wonder how that can happen without any soft LUDs at all, but anything is possible). I will keep my fingers crossed and hope for the best.

Great discussion here, its great to see prospective from many folks.
    Wonderful insights.

    Man great venting.

Here is a question for you and for all of us in similiar circumstances. you got to ask a question.....what will make you happy. You took a great step in buying the house not because of any reason other than "you wanted your daughter needed some place to play". You took the decision, made a choice....Now you should be happy for you did what you deened important for you and you did it.
Now things went bad after buying a house, but overall you choose to buy this and that should make you happy.

Nothing personal Sagi13...your write was excellent about changes with in 9 months. It will all work out for you.

I read somewhere "happiness is in action". Its far more easier to ask sorry for something done, than to repent for something left undone.

For me what has worked so far is trying to stay out of Rat Race, and this too by choice.
I choose not to waste money on new cars, not my type, i refuse to judge people by the cars they drive. i have driven decent cars, but never paid a penny to anyone on car loan interest. So will i do for a house, god willing.
i make sure to spend a lot of time with family and friends, and real time spend relaxing, enjoying sun ...walks in morning.

i did spend a lot of money this last year on soft factors/family and friends...more than 10K ...i choose to do so; and i am happy so far.
This may not be a big amount for someone, and this expense could have been avoided but we choose to spend it, fine no issues.

My belief is, one got to make peace with one self, past is past ..and stop comparisons
We all make mistakes, i make more mistakes than my fair share of "1" a day...

Remember "we are spritual beings having human experiences". T

Here is another good line i try to remember always, think about what do you want...lets say GC.

Imagine you got GC what will you do differently than what you are doing today. what change will GC bring to you as a person ( forget other crazy ideas we have created in our help in job, realizing american dream, and please Donot cite reasons like it will be easier to travel/get a job. )
If you donot have any solid differences in your life...after getting a GC...then my friend you are in Rat Race.

This American dream is a bull marketers, this is a dream for everyone on this planet, and most achieve having a space where they can relax not by owning something....ownership is perceived notion. How can owning a piece of wood and concrete help anyone??

Though I don't like your language and attitude, you have a valid point. I honestly feel that those who have used labor substitution should not get their green cards earlier than me.

First, with out name check cleared by FBI, no 485 will be approved. Assiging visa number to a 485 appliction initally, nothing to do with name check. If the applicant is threat to the security of the country, his/her 485 will be denied and they will take back the already assigned number. Both are two different issues.

Another myth: USCIS processed 60,000 485 in June. It is wrong. They processed 60,000 485 over the period of 6 months to 5 years. And they just approved in June, based on earlier processing.

Ramba, is that mean they might use less than 140K visas in 2007, because the name check may not be cleared for all 20K applictions in 3 months.

This is the press release in April that became effective Jun 18th

And this is the inter office memo

It does say CIS MAY deny a case if the initial evidences are missing , though adjudicators are urged to use this option judiciously.

Mine was filed without EVL and it has been receipted (in June). My lawyer asked me not to worry about it.

I think movement in EB-3 for India nad Chine will be difficult, as most of the folks from ROW apply under EB3 and most of the applicants in EB2 are from India and Chine?
As a result EB-3 quota is used up easily and the per country limits apply for Indians and Chinese. Where as for EB-2, the per country limits do not apply as the ROW applicants are not that many.

After the stunning demand for the H-1B visa this year, people began to investigate the problem. Congress and the White House are trying to craft major immigration reform this year, and an understanding of the situation is critical.

What has been noticed is that between 70% and 80% of the H-1B visas granted in 2006 went to India-based outsourcing firms. Employees of these firms were not being hired to work for U.S. businesses but, rather, to effectively study how U.S. businesses operate and to determine their needs and methods.

I am worried bcoz, on my EAD card its written "NOT VALID FOR REENTRY TO U.S."

    what does this mean?

    Please advise.

It means you can not use EAD as a travel document to reenter to U.S. You should have valid Visa for reentry.

Hi, I hope somebody helps in my dilemma.

I am currently on an L1A visa. I heard that my main office (where I am now working) is closing the foreign office where I come from. Based on L1 requirements and facts, it states that once the subsidiary closes, my L1 becomes invalid. Given this, the company is willing to sponsor my green card as soon as possible. It will probably still take a year before the subsidiary officially closes. What are my options? If they have to close the company while my green card is being process, would it be cancelled ?

i am not a lawyer -so get expert opinion.....

but the logic of L1A becoming instantly invalid for someone already in US office if the foreign office closes does not sound logical, even by USCIS standards. I would suggest taking a good 2nd opinion.

Also - if you are in L1A - you should technically qualify for EB-1 which is current for all countries and if that category applies to your situation - you would not need to go through Labor Cert - a couple of friends of mine got their GC in less than 90 days using the EB1 route.

    All the best!

Look below the URL. If they are doing it. It is legal. But If some one is denied entry, they can also challenge the decision. Consultants especially will need to use proper/legal answers.

    (5) Labor certification and qualifications for certain immigrants.-

    (A) Labor certification.-

    (i) In general.-Any alien who seeks to enter the United States for the purpose of performing skilled or unskilled labor is inadmissible, unless the Secretary of Labor has determined and certified to the Secretary of State and the Attorney General that-

    (I) there are not sufficient workers who are able, willing, qualified (or equally qualified in the case of an alien described in clause (ii)) and available at the time of application for a visa and admission to the United States and at the place where the alien is to perform such skilled or unskilled labor, and

(II) the employment of such alien will not adversely affect the wages and working conditions of workers in the United States similarly employed.

(ii) Certain aliens subject to special rule.-For purposes of clause (i)(I), an alien described in this clause is an alien who-

    (I) is a member of the teaching profession, or

(II) has exceptional ability in the sciences or the arts.

If you really believe that this bogus bill will become a Law, then also see the real picture, that is why I posted the other Ifs.

This Bill is titled as "Employ America Act". By having the GC, you are not an American. If you do not know the rule here it is, GC is a "Privilege", and it is not a "Right". So if this Bill passes all these people with alerady having GC will also need to pack their Bags and Go. That is the reality, dude.

So again and again do not fall over it. If you respond to this Bill, and Vote "No" against it, you are trying to send wrong messages to the originators of the bill, that we are scared. Why you guys are making everyone scared, when there is nothing to be scared about.
So hitting YES you are going to convey you are bold and ready to leave the country middle of this night with your kids leaving studies ? what is your profile though are you really an Prospective immigrant i doubt it.

    03-04 03:39 PM
    According to Mr. Gotcher (
Here are of the 5th and 6th paragraphs from Visa Quotas section at the very first post.

In addition to the fall down numbers, there are also spill over numbers. That is, to the extent that the worldwide category does not use all of the numbers available to it, the remaining numbers spill over and become available to the countries that are impacted by the single country limit.

In order for there to be spill over numbers, however, the worldwide third preference category much be current (that is, it may not have a cutoff date). When this happens, then unused worldwide numbers spill over and become available for applicants affected by the single country limit.
